Welcome to Wiamé (the "Site"). These Terms and Conditions (the "Terms") govern your access to and use of the website located at www.wiamé.com (and its punycode equivalent www.xn--wiam-epa.com) and your purchase of any products offered through the Site. The Site is owned and operated from Alberta, Canada.
By accessing, browsing, or making a purchase through this Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site or place an order.
Nothing in these Terms is intended to limit or override any rights, remedies, or protections you may have under applicable consumer protection legislation, including Alberta's Consumer Protection Act and Internet Sales Contract Regulation. Where any provision of these Terms conflicts with a mandatory statutory right, the statutory right will prevail to the extent of that conflict.

Wiamé operates exclusively online and does not maintain a public storefront or walk-in location. All customer interactions take place electronically. For the purposes of Alberta's Internet Sales Contract Regulation, this section, together with the order confirmation we send you, satisfies the supplier disclosure requirement. If you require a mailing address for legal correspondence, please first contact us at wiameorder@gmail.com and we will provide one. If any of the above contact details change, we will post the updated information on the Site.
2. Eligibility
You must be at least 18 years of age (or the age of majority in your province, territory, state, or country of residence, whichever is greater) to place an order on the Site. By placing an order, you represent and warrant that:

the information you provide is true, accurate, current, and complete; and

you have the legal capacity to enter into a binding contract.
If you are accessing the Site on behalf of a business, you represent that you have authority to bind that business to these Terms.
3. Products and Product Information
Wiamé sells outdoor, fitness, and travel accessories, including hydration packs, cycling bags, crossbody bags, and related gear.
We make reasonable efforts to display product descriptions, photographs, dimensions, colours, and specifications as accurately as possible. However:

Product images are for illustrative purposes. Actual colours may vary slightly due to monitor, screen, and lighting differences.

Minor variations in dimensions, stitching, hardware, and finishing may occur, particularly for sewn or hand-finished goods.

Product availability is not guaranteed. We reserve the right to discontinue any product, limit quantities, or correct typographical errors in descriptions and pricing at any time.
If a product you ordered is materially different from how it was described on the Site, your remedies are set out in the Returns and Refunds section below and in applicable consumer protection law.
4. Pricing, Currency, Taxes, and Charges

Currency. Unless clearly indicated otherwise on the product page or at checkout, all prices are listed in Canadian Dollars (CAD).

Taxes. Where applicable, GST, HST, PST, QST, or equivalent sales taxes will be calculated and added at checkout based on your delivery address. International orders may be subject to import duties, customs fees, brokerage fees, or other taxes levied by the destination country. These charges are the responsibility of the customer and are not included in the product price or shipping cost shown at checkout.

Total amount payable. Before you confirm your order, the checkout page will display the full price, taxes (if any), shipping charges, and the total amount owing.

Pricing errors. If we discover a pricing error on a product after you have placed an order, we will contact you before processing the order. You may choose to proceed at the corrected price or cancel the order for a full refund.

Promotions and sale pricing. Promotional codes, sale prices, and discounts cannot be combined unless we expressly say so, are valid only for the period stated, and may be withdrawn at any time. Promotions may not be applied retroactively to previous orders.
5. Placing an Order and Order Acceptance
When you submit an order through the Site, you are making an offer to buy the products at the prices and on the terms shown at checkout. Your order is not accepted, and no contract is formed, until we send you an order confirmation email accepting the order.
Before you submit your order, you will have an opportunity to review your order summary, correct any errors, and accept or decline the purchase. By clicking "Place Order" (or equivalent), you confirm that the information is correct and that you accept these Terms.
We may, at our discretion, refuse or cancel any order, including (without limitation) where:

the product is out of stock or unavailable;

there is an error in pricing or product information;

we suspect fraud, unauthorized payment, or a breach of these Terms;

we are unable to verify the billing or shipping information; or
-
we are prohibited by law from shipping to your jurisdiction.
If we cancel an order after payment has been taken, we will refund the full amount paid using the original payment method.
6. Payment
We accept the payment methods displayed at checkout. Payment is processed by third-party payment providers. By providing payment information, you represent that you are authorized to use the payment method.
You agree to pay all charges incurred under your account, including applicable taxes and shipping fees.
We do not store full credit card numbers on our servers. Payment data is handled in accordance with our Privacy Policy and by our payment processors under their own security standards.
7. Shipping and Delivery
We offer worldwide shipping. Specific shipping times, methods, and any free-shipping eligibility are set out at checkout and on the product page.

Processing time. Orders are typically processed within the timeframe shown at checkout. Processing time is in addition to shipping/delivery time.

Estimated delivery dates. Any delivery time we display is an estimate, not a guarantee. Delivery may be affected by carrier delays, weather, customs clearance, public holidays, strikes, or other events outside our reasonable control.

Delivery within 30 days. Where required by Alberta's Internet Sales Contract Regulation or other applicable law, if we are unable to deliver your goods within 30 days of the delivery date specified at the time of purchase (or any amended delivery date you and we agreed to in writing or electronically), you may cancel the contract and receive a refund of all amounts paid.

Title and risk. Title to and risk of loss for products pass to you when the carrier delivers the goods to the shipping address you provided.

Incorrect address. It is your responsibility to provide an accurate, complete, and current shipping address. We are not responsible for orders shipped to an incorrect address provided by you. Re-shipping costs for packages returned due to an incorrect or incomplete address will be charged to you.

Customs and duties. For international orders, you are the importer of record and are responsible for complying with all laws and regulations of the destination country, including any customs duties, taxes, and brokerage fees. We have no control over these charges and cannot predict their amount.

Lost or damaged in transit. If your package appears lost or arrives damaged, contact us at wiameorder@gmail.com as soon as possible and within 14 days of the expected delivery date (or actual delivery, for damage). We will work with you and the carrier to investigate and resolve the issue.
8. Returns, Exchanges, and Refunds
We want you to enjoy your Wiamé products. If something isn't right, we will work with you in good faith to make it right.
8.1 Statutory cancellation rights (Alberta)
If you are an Alberta resident purchasing for personal, family, or household use and the price of the goods or services exceeds $50, the Internet Sales Contract Regulation gives you the right to cancel the contract in certain situations, including (without limitation):

within 7 days after receiving a copy of the contract, if we did not disclose the required information before you entered into the contract, or did not provide an express opportunity to accept or decline the contract or correct errors;

within 30 days after the contract was entered into, if we did not provide a copy of the contract within 15 days; and
-
at any time before delivery, if we do not deliver the goods within 30 days after the delivery date specified in the contract (or an agreed amended date).
To exercise a statutory cancellation right, send a notice of cancellation to wiameorder@gmail.com. The notice can be in any form, as long as it makes your intention to cancel clear. Where required, we will refund all amounts paid within 15 days of cancellation.
If you live in another Canadian province, U.S. state, or country, you may have similar statutory rights — these Terms do not limit those rights.
8.2 Voluntary returns
In addition to your statutory rights, we offer the following voluntary return policy:

Return window. You may request a return within 30 days of receiving your order.

Condition. Items must be unused, unworn, unwashed, and in their original packaging with all tags and accessories. We reserve the right to refuse returns of items that show signs of use, wear, damage caused after delivery, or that are missing components.

Non-returnable items. For hygiene and safety reasons, the following are not eligible for voluntary return (unless defective or not as described): hydration bladders or reservoirs that have been used, intimate/skin-contact items, and final-sale items clearly marked as such at the time of purchase.

How to start a return. Email wiameorder@gmail.com with your order number, the item(s) you wish to return, and the reason. We will reply with return instructions.

Return shipping costs. For voluntary returns (change of mind, sizing, etc.), you are responsible for return shipping costs unless the item is defective, damaged on arrival, or not as described, in which case we will cover return shipping. Where a statutory cancellation right applies and is exercised, we will cover the reasonable cost of return shipping as required by law.

Refunds. Once we receive and inspect your return, we will notify you of the outcome. Approved refunds are issued to the original payment method, typically within 7–14 business days. The original outbound shipping cost is non-refundable for voluntary returns unless the return is due to our error or a defective product.

Exchanges. Exchanges are subject to stock availability. If the replacement item is not available, we will issue a refund instead.
8.3 Defective or incorrect items
If you receive a defective, damaged, or incorrect item, please contact wiameorder@gmail.com within 14 days of delivery with photos and your order number. We will arrange a free replacement, repair, or refund at our option and at no cost to you.
9. Promotions, Discount Codes, and Newsletter Subscription
From time to time we may offer promotions, discount codes, or loyalty incentives. Each promotion is subject to its own specific terms, which we will make available when the promotion is offered. Promotions may not be combined, are non-transferable, have no cash value, and may be modified or cancelled by us at any time before redemption.
If you subscribe to our newsletter, you consent to receive commercial electronic messages from Wiamé in accordance with Canada's Anti-Spam Legislation (CASL). You can unsubscribe at any time using the link in any email we send, or by contacting wiameorder@gmail.com.
10. Account Registration
You may be able to create an account on the Site. You are responsible for:

providing accurate information when registering;

keeping your password confidential; and
-
all activity that occurs under your account.
Notify us immediately at wiameorder@gmail.com if you suspect unauthorized use of your account. We may suspend or terminate accounts that violate these Terms, that show signs of fraudulent activity, or that have been inactive for an extended period.
11. Acceptable Use
When using the Site, you agree not to:

use the Site for any unlawful purpose or in violation of these Terms;

attempt to gain unauthorized access to the Site, our servers, accounts, or any related systems;

interfere with or disrupt the Site, including by introducing viruses, malware, or other harmful code;

use automated tools (bots, scrapers, crawlers) to collect data from the Site except for legitimate search-engine indexing;

impersonate any person or misrepresent your affiliation;

resell or commercially exploit products purchased from the Site without our written consent;

post or transmit content (including in reviews) that is defamatory, harassing, hateful, obscene, infringing, or otherwise unlawful.
We may, at our discretion, restrict access, cancel orders, or take legal action against users who breach this section.
12. Customer Reviews and Submissions
If we allow product reviews or other user submissions, you grant Wiamé a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, adapt, publish, and display your submissions in connection with our business. You represent that your submission is your own original content, is truthful, and does not violate any third-party rights.
We do not edit or suppress reviews based on whether they are positive or negative, but we may remove reviews that contain unlawful content, personal information about others, off-topic content, spam, or that violate these Terms.
13. Intellectual Property
All content on the Site — including the Wiamé name, logo, product designs, photographs, graphics, page layouts, text, and software — is owned by Wiamé or its licensors and is protected by Canadian and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, scrape, frame, or create derivative works from any Site content without our prior written consent, except as expressly permitted by applicable law.
Third-party product names and trademarks (for example, brand names of items we resell) belong to their respective owners and are used for identification purposes only.
14. Third-Party Links and Services
The Site may contain links to third-party websites, services, or content (for example, payment processors, shipping carriers, or social media platforms). We are not responsible for the content, accuracy, privacy practices, or availability of any third-party site or service. Your dealings with third parties are solely between you and them.

16. Disclaimer of Warranties
Except for warranties that cannot be excluded under applicable consumer protection or sale-of-goods legislation (which remain fully in effect to the extent required by law):

the Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement;

we do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected; and

You are responsible for assessing whether a product is suitable for your intended use. For activity-specific gear (cycling bags, hydration packs, running accessories, etc.), please follow the manufacturer's instructions and use the product safely.
17. Limitation of Liability
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for:

death or personal injury caused by our negligence;

fraud or fraudulent misrepresentation; or
-
any other liability that the law does not allow us to limit or exclude (including, where applicable, certain rights and remedies under consumer protection legislation).
Subject to the above:

To the maximum extent permitted by law, Wiamé, its owners, employees, and suppliers are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or in connection with the Site or any product purchased through the Site, even if advised of the possibility of such damages.

Our total aggregate liability to you for all claims arising out of or related to a particular order is limited to the amount you paid us for the products in that order.
18. Indemnification
You agree to indemnify and hold harmless Wiamé and its owners, employees, agents, and suppliers from any claims, losses, damages, liabilities, and reasonable legal fees arising out of:

your breach of these Terms;

your misuse of the Site or any product purchased through the Site; or

your violation of any law or third-party right.
This section does not apply to the extent a claim arises from our own negligence or willful misconduct, or where indemnification is restricted by applicable consumer protection law.
19. Force Majeure
We are not liable for any failure or delay in performance caused by events outside our reasonable control, including natural disasters, fires, floods, severe weather, pandemics, public health emergencies, war, terrorism, civil unrest, labour disputes, internet or utility outages, supplier or carrier delays, customs holds, government orders, or other events of force majeure. If such an event occurs, we will use reasonable efforts to notify you and to resume performance as soon as practicable.
20. Governing Law and Jurisdiction
These Terms, and any contract formed under them, are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.
Subject to your mandatory rights as a consumer (including the right to bring proceedings in the courts of your home jurisdiction where the law gives you that right), you agree that the courts of the Province of Alberta will have non-exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
This clause does not deprive you of the protection of mandatory consumer protection laws of the jurisdiction in which you ordinarily reside.
21. Dispute Resolution
Before starting any formal proceeding, we encourage you to contact us at wiameorder@gmail.com so we can try to resolve the issue informally. Most concerns can be addressed quickly this way.
If we cannot reach a resolution, you retain all rights and remedies available to you under applicable law, including the right to file a complaint with consumer protection authorities (for Alberta residents, Service Alberta's Consumer Contact Centre) or to bring proceedings before a court of competent jurisdiction.
Nothing in these Terms requires you to waive your right to participate in class proceedings or to give up access to the courts where such waivers are prohibited by applicable consumer protection law.
22. Changes to These Terms
We may update these Terms from time to time to reflect changes in our business, our products, or the law. The "Last Updated" date at the top of this page indicates when the Terms were last revised. Material changes will be posted on the Site and, where reasonably practicable, communicated to registered customers by email. Orders placed before a change takes effect are governed by the Terms in force when the order was placed.
Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
23. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or, if that is not possible, severed. The remaining provisions will continue in full force and effect.
24. No Waiver
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Wiamé.
25. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a sale, merger, restructuring, or other transfer of our business, provided your rights as a consumer are not diminished.
26. Entire Agreement
These Terms, together with our Privacy Policy, Accessibility Statement, any order confirmation, and any policies referenced on the Site (such as shipping or return policies), constitute the entire agreement between you and Wiamé regarding your use of the Site and your purchase of products, and supersede any prior agreements or understandings on the same subject matter.
27. Language
These Terms have been drafted in English at the express request of the parties. Les présentes conditions ont été rédigées en anglais à la demande expresse des parties. If we provide a translation of these Terms in another language and there is a conflict, the English version will prevail to the extent permitted by law.
