Wiamé ("we," "us," "our") respects your privacy and is committed to handling your personal information responsibly, transparently, and in compliance with applicable Canadian privacy laws. These laws include:

  • the federal Personal Information Protection and Electronic Documents Act (PIPEDA);

  • Alberta's Personal Information Protection Act (PIPA), as we operate from Alberta;

  • Canada's Anti-Spam Legislation (CASL); and

  • where applicable, the privacy laws of other provinces (such as Quebec's Act respecting the protection of personal information in the private sector, commonly known as "Law 25") and other jurisdictions where our customers reside.

This Privacy Policy explains what personal information we collect, why we collect it, how we use, share, store, and protect it, and the rights you have over your information. It applies to www.wiamé.com (and its punycode equivalent www.xn--wiam-epa.com) and to any orders or interactions you have with us through the Site.

By using the Site, contacting us, or placing an order, you acknowledge that you have read and understood this Privacy Policy. Where the law requires your consent (express or implied), we rely on the consent mechanisms described below.

Wiamé operates exclusively online and does not maintain a public storefront. Our Privacy Officer is responsible for our compliance with this Privacy Policy and with applicable privacy laws. If you have any questions, concerns, complaints, or requests relating to your personal information, please contact us at the email above with the subject line "Privacy Request."

2. What Is Personal Information

For the purposes of this Privacy Policy, "personal information" means information about an identifiable individual, as defined in PIPEDA and Alberta PIPA. It does not include business contact information used solely to communicate with an individual in connection with their employment, business, or profession, or information that has been irreversibly anonymized or aggregated.

3. Personal Information We Collect

We only collect personal information that is reasonably necessary for the purposes set out in this Policy. The types of information we may collect include:

3.1 Information you provide to us directly

  • Account and order information — first and last name, email address, shipping address, billing address, phone number (if provided), order history, and account login credentials (if you create an account).

  • Payment information — payment is processed by our third-party payment processors (for example, Wix Payments, Stripe, PayPal, or similar). We do not store full credit card numbers on our own servers; we receive only limited transaction details (such as confirmation of payment, last four digits of the card, card type, and billing address) as needed to process and verify orders.

  • Communications — the content of any messages you send us through our contact form, by email, or via social media, including your name, contact details, and the substance of your inquiry.

  • Newsletter and marketing preferences — your email address and consent status if you choose to subscribe.

  • Reviews, feedback, or other submissions — any voluntary content you provide.

  • Contest, survey, or promotion entries — if you participate, the information requested for that activity.

3.2 Information we collect automatically

When you visit the Site, we (and the third-party platforms that power the Site, primarily Wix.com Ltd. — see Section 7) may automatically collect:

  • Device and technical information — IP address, browser type and version, operating system, device identifiers, time zone setting, language preferences;

  • Usage information — pages viewed, items added to cart, links clicked, time spent, referring URL, and similar analytics data;

  • Cookies and similar technologies — small data files placed on your device. We use cookies for purposes including site functionality, security, analytics, and (where you consent) marketing. See Section 8 for details.

3.3 Information from third parties

  • Payment processors confirm transaction details to us.

  • Shipping carriers provide tracking, delivery confirmations, and (occasionally) updated address information.

  • Social media platforms — if you interact with us on social media or click on our ads, we may receive limited information from those platforms in accordance with the privacy settings you have configured with them.

  • Fraud-prevention services that help us screen orders for suspicious activity.

3.4 What we do not intentionally collect

We do not knowingly collect sensitive information such as government-issued ID numbers, social insurance numbers, financial account numbers beyond what is required to process a refund, health information, or biometric data. Please do not send us this kind of information.

4. Why We Collect, Use, and Disclose Personal Information (Purposes)

In accordance with PIPEDA's "identifying purposes" principle and Alberta PIPA's reasonable-purpose requirement, we collect, use, and disclose your personal information only for the following purposes:

  1. To process and fulfil your orders — including taking payment, verifying your identity, preparing shipments, providing tracking, handling returns and refunds, and responding to questions about your order.

  2. To manage your account — including authentication, password resets, and order history.

  3. To communicate with you — to send order confirmations, shipping updates, customer-service responses, important notices about your account or these policies, and other transactional messages. These transactional messages are not promotional, so we send them without separately requesting marketing consent.

  4. To send you marketing communications — only where you have provided express consent (for example, by subscribing to our newsletter) or where implied consent is permitted under CASL (for example, for two years after a purchase). Every marketing email includes an unsubscribe link.

  5. To improve our products, services, and Site — by analyzing aggregated usage data, monitoring performance, and conducting research.

  6. To personalize your experience — for example, by remembering items in your cart or showing relevant products.

  7. To prevent fraud and protect security — verifying transactions, detecting suspicious activity, enforcing our Terms and Conditions, and protecting our customers, employees, and property.

  8. To comply with legal and regulatory obligations — including tax, accounting, consumer protection, anti-money-laundering, and responding to lawful requests from authorities.

  9. To establish, exercise, or defend legal claims — where reasonably necessary.

If we ever want to use your personal information for a new purpose that was not identified at the time of collection, we will obtain your consent unless the new use is authorized or required by law.

5. Consent

5.1 How we obtain consent

We obtain your consent in different ways depending on the sensitivity of the information and the circumstances:

  • Express consent — for example, when you tick a box to subscribe to our newsletter, agree to these terms during checkout, or expressly agree to a specific use of your information.

  • Implied consent — when the purpose is obvious and you voluntarily provide the information (for example, providing your shipping address so we can ship your order).

  • Deemed consent — in limited cases authorized by law (for example, disclosure to a service provider to fulfil the purpose for which the information was originally collected).

5.2 Withdrawing your consent

You can withdraw your consent to our use or disclosure of your personal information at any time, subject to legal or contractual restrictions and reasonable notice. To withdraw consent:

6.1 Service providers

We share information with carefully selected third-party service providers that help us operate our business, on the condition that they protect your information and use it only for the purposes for which we engaged them. Categories include:

  • Website platform and hosting — Wix.com Ltd. (which hosts our Site and may store personal information on servers located in the United States, Europe, Israel, and other jurisdictions where Wix or its sub-processors operate);

  • Payment processors — for example, Wix Payments, Stripe, PayPal, or similar (which process payments and may carry out fraud screening);

  • Shipping carriers and logistics providers — to deliver your orders;

  • Email and marketing platforms — to send transactional and (where you have consented) marketing emails;

  • Analytics providers — such as Google Analytics or similar tools used through Wix, to understand Site usage;

  • Customer-support tools and CRM systems;

  • Fraud-prevention and security vendors;

  • Professional advisors — including accountants, auditors, and lawyers, as needed.

6.2 Legal and protective disclosures

We may disclose personal information without your consent where permitted or required by law, including:

  • to comply with a subpoena, warrant, court order, or other legal process;

  • to cooperate with law-enforcement, regulatory, or government authorities exercising lawful authority;

  • to investigate or prevent fraud, security incidents, or violations of our Terms and Conditions;

  • to protect the rights, property, or safety of Wiamé, our customers, employees, or others;

  • in an emergency that threatens the life, health, or security of an individual.

6.3 Business transactions

If Wiamé is involved in a merger, acquisition, restructuring, financing, sale of assets, or insolvency, personal information may be disclosed to the parties involved in the transaction, subject to obligations of confidentiality. Where the transaction proceeds, the receiving party will be required to use the personal information only for the purposes for which it was originally collected and consistent with this Privacy Policy.

6.4 With your consent

We may share your information for any other purpose with your express consent or at your direction.

7. Cross-Border Transfers and Storage Outside Canada

Because our Site is hosted on Wix.com and we use third-party service providers, your personal information may be transferred to, stored, processed, or accessed in countries outside Canada, including the United States, the European Union, Israel, and other jurisdictions where our service providers operate.

As required by Alberta PIPA, you should be aware that:

  • Some of our service providers operate outside of Canada. The primary service providers we use that may store or process personal information outside Canada include Wix.com Ltd. (and its sub-processors), our payment processors, shipping carriers, email and marketing platforms, and analytics providers.

  • Personal information may be subject to the laws of those jurisdictions, including lawful access requests by foreign courts, law-enforcement agencies, and government authorities. The legal protections in those jurisdictions may differ from those in Canada.

  • We require our service providers to protect personal information to a standard comparable to what is required under Canadian privacy law, through contractual commitments such as data-processing agreements and (where applicable) Standard Contractual Clauses.

8. Cookies and Tracking Technologies

8.1 What cookies we use

Our Site, like most e-commerce sites, uses cookies and similar technologies. The categories include:

  • Strictly necessary / essential cookies — required for the Site to function (for example, to maintain your session, keep items in your cart, process secure transactions, and prevent fraud). These cannot be disabled.

  • Functional cookies — remember your preferences (such as language).

  • Analytics / performance cookies — help us understand how visitors interact with the Site so we can improve it.

  • Marketing / advertising cookies — used (only with your consent, where required) to deliver relevant ads and measure their effectiveness.

Many of these cookies are set by Wix or by Wix-integrated third parties; you can review Wix's list of cookies and their purposes in the Wix Cookie Policy.

8.2 Managing cookies

Where required by law (for example, for visitors from the EU, UK, or Quebec), we display a cookie banner that lets you accept or reject non-essential cookies. You can also manage cookies through your browser settings — most browsers allow you to refuse, delete, or be notified of cookies. Note that blocking essential cookies may prevent parts of the Site (especially checkout) from working properly.

8.3 Do Not Track

We do not currently respond to "Do Not Track" browser signals, as there is no industry standard for how to do so. However, you can control tracking through the cookie banner and browser settings described above.

9. Newsletter and Marketing Communications (CASL Compliance)

We send marketing emails only in compliance with Canada's Anti-Spam Legislation (CASL):

  • We send marketing emails only to people who have given us express consent (for example, by subscribing through our newsletter form and confirming the subscription) or where implied consent is allowed under CASL (for example, within two years of a purchase from us, or within six months of an inquiry).

  • Every marketing email identifies us, provides our contact information, and includes a working unsubscribe link that remains functional for at least 60 days.

  • We process unsubscribe requests within 10 business days, as required by CASL.

  • We keep records of consents for the period required by law.

If you ever receive a marketing email from us that you did not consent to, please contact wiameorder@gmail.com and we will investigate and address it promptly.

10. How We Protect Your Information (Safeguards)

We take the security of your personal information seriously and use reasonable physical, technical, and organizational safeguards appropriate to the sensitivity of the information, including:

  • Encryption in transit — our Site uses HTTPS/TLS encryption (provided through Wix) to protect data sent between your device and the Site, especially during checkout and login;

  • Secure payment processing — handled by PCI-DSS-compliant third-party processors; we do not store full payment card numbers on our own servers;

  • Access controls — we limit access to personal information to people who need it to perform their role;

  • Account security — passwords are stored in encrypted form (Wix uses one-way encryption for passwords);

  • Service provider contracts — written agreements requiring our service providers to protect your information;

  • Ongoing review of our security practices.

Despite these measures, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security. You play an important role too — please use a strong, unique password for your account, keep your login credentials confidential, and contact us immediately if you suspect any unauthorized access to your account.

11. Data Retention

We keep personal information only as long as reasonably necessary for the purposes set out in this Privacy Policy or as required by law. Examples of the retention periods we apply:

  • Order records — retained for at least 6 years from the end of the fiscal year of the transaction to meet Canadian tax, accounting, and consumer protection requirements;

  • Account information — retained while your account is active and for a reasonable period after closure for security and dispute-resolution purposes;

  • Marketing records — retained while you remain subscribed and for at least 3 years after unsubscribe, to demonstrate consent under CASL;

  • Customer-support communications — retained for a reasonable period to resolve issues and document responses;

  • Website analytics data — retained for the period determined by the analytics provider's standard settings (you can request a shorter period through cookie controls).

When personal information is no longer required, we securely destroy, erase, or anonymize it.

12. Privacy Breach Notification

If we experience a data breach involving your personal information that creates a real risk of significant harm to you, we will:

  • notify the Office of the Information and Privacy Commissioner (OIPC) of Alberta (under Alberta PIPA) or the Office of the Privacy Commissioner of Canada (under PIPEDA), as applicable;

  • notify you without unreasonable delay, with information about what happened, what information was involved, what we are doing in response, and what you can do to protect yourself; and

  • keep records of the breach as required by law.

13. Your Privacy Rights

Subject to certain legal exceptions and verification of your identity, you have the following rights regarding your personal information:

  • Right of access — you may ask us what personal information we hold about you and request a copy of it.

  • Right to correction — you may ask us to correct personal information that is inaccurate or incomplete.

  • Right to withdraw consent — you may withdraw consent to our use or disclosure of your information (see Section 5.2).

  • Right to delete / be forgotten — you may request that we delete personal information we hold about you. We will honour the request unless we are required or permitted by law to keep it (for example, for tax records).

  • Right to data portability — where required by law (such as Quebec's Law 25), you may request that we provide your personal information in a structured, commonly used technological format.

  • Right to challenge our compliance — you may file a complaint with us if you believe we have not complied with this Privacy Policy or with applicable privacy law (see Section 14).

  • Right to lodge a complaint with a regulator — see Section 14.

To exercise any of these rights, email wiameorder@gmail.com with the subject line "Privacy Request." We may need to verify your identity before responding. We will respond within the timeframes required by applicable law — generally within 30 days under Alberta PIPA and PIPEDA, with a possibility of extension where reasonable.

There is no fee to exercise these rights in most cases. If a request is manifestly unfounded, excessive, or repetitive, we may charge a reasonable fee or refuse to act on the request, in accordance with applicable law.

14. How to Make a Complaint

If you have a concern about how we have handled your personal information, please contact our Privacy Officer first at wiameorder@gmail.com with the subject line "Privacy Complaint." We will investigate and respond in writing.

If you are not satisfied with our response, you have the right to file a complaint with the appropriate privacy regulator:

15. Children's Privacy

Our Site is not directed at children and we do not knowingly collect personal information from children under the age of 13 (or the equivalent minimum age in your jurisdiction). If we learn we have inadvertently collected personal information from a child under 13 without verified parental consent, we will delete it promptly. If you are a parent or guardian and believe your child has provided us with personal information, please contact us at wiameorder@gmail.com.

To purchase from the Site, you must be at least the age of majority in your province, territory, or country of residence, as set out in our Terms and Conditions.

16. Third-Party Links

The Site may contain links to third-party websites, services, or social-media platforms. We are not responsible for the privacy practices of those third parties. We encourage you to read their privacy policies before providing any personal information.

17. Automated Decision-Making and Profiling

We do not use your personal information to make decisions that produce legal effects on you or similarly significantly affect you through purely automated means. Fraud-screening tools used by our payment processors may use automated analysis to flag potentially suspicious transactions, but flagged orders are reviewed before any action is taken.

18. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, services, technology, or the law. The "Last Updated" date at the top of this page shows when the Policy was last revised.

  • Minor updates (such as clarifications) take effect when posted.

  • Material changes (such as new purposes for which we use your information) will be communicated to you in a more visible way, such as a notice on the Site or an email to registered customers, before they take effect. Where required by law, we will obtain your renewed consent.

Your continued use of the Site after a Privacy Policy update constitutes acceptance of the updated Policy, subject to any consents we are required to obtain.

19. Language

This Privacy Policy has been drafted in English at the express request of the parties. La présente politique de confidentialité a été rédigée en anglais à la demande expresse des parties. If we provide a translation in another language and there is a conflict, the English version will prevail to the extent permitted by law.
